Notwithstanding provisions to the contrary, the parties agree that, if Buyer requires new access to ownership under this Section 8.04 after the date of signature, the parties must enter into a separate agreement, substantially in the same form as the ESA Phase II Agreement, before Seller or Seller`s representatives enter the property (an „Access Agreement”). 7.1.f. By participating in the management mechanisms, NASA and ESA agree to achieve a common ground on the space station, in accordance with the general security requirements of the space station referred to in Article 10. NASA and ESA also agree to go through management mechanisms in order to set up, if necessary, standard interfaces for space station users in stationary printing laboratories. Exemptions from these sharing requirements may be agreed on a case-by-case basis between NASA and ESA. In addition, NASA and ESA will use the above-mentioned management mechanisms to reach, on a case-by-case basis, an agreement on the use of interchangeable hardware and software, in order to promote the efficient and effective operation of the space station, including the reduction of the load on the space station logistics system. 12.2.g. With regard to usage activities, each partner, in liaison with its space station users, will provide communication services on a reimbursable basis for the provision of communication services or will agree with other partners. Reimbursement for these services can be made in cash or as agreed. All refundable communication services are provided under communication service contracts. The right to obtain the TDRSS or RSA satellite data transmission capacity and the data transmission capacity provided by other partners to the extent that this applies to the use of the space station is provided for in Article 8.3.d.
The partners will do everything in their power to meet the specific needs of the other space station through their respective communication systems. The contracting authority shall conclude an agreement with the ESA supplier. The ESA supplier may also entrust project management know-how to third-party companies such as ESCOs (energy service companies), construction companies and engineering offices. In this way, the ESA supplier can also agree to be responsible for the provision of ongoing maintenance, upgrades and improvements to ensure the sustainable success of the project. As a general rule, ESA providers take the risk of saving savings to justify the investment by providing performance guarantees (insurance). 14.6. Following the review and assessment referred to in Article 14(5) and in accordance with the provisions of the Intergovernmental Agreement, cooperation between or between partners with regard to the sharing of the evolutionary capability(ies) requires the amendment of this Memorandum of Understanding, the Memorandum of Understanding between NASA and GOJ, the Memorandum of Understanding between NASA and CSA and/or the Memorandum of Understanding between NASA and RSA, or a separate agreement involving NASA to ensure that each complement is consistent with the entire program and any other partner providing a space station element or space transport system with an operational or technical impact. . .
